Brazil's Federal Supreme Court (STF) justice Edson Fachin withdrew from Tuesday's agenda the trial of the appeal requested by the defense of former President Luiz Inacio Lula da Silva aimed at suspending an appeal to the 4th Regional Federal Court (TRF-4) that questions his conviction to 12 years and a month of imprisonment for passive corruption and money laundering.
Fachin dismissed the petition made by the former president's defense since the extraordinary appeal was pending admissibility when the petition was filed.
After the request, the appeal was denied by the vice-presidency of the TRF-4, which changes the procedural framework, according to Fachin.
According to him, now, it should be up to Lula's defense to file a complaint against the decision that rejected the appeal to the STF.
